The new Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam which will come into effect in July, 2020 is expected to promote investment and economic growth in the country by allowing foreigners to enter and reside in Vietnam with more ease and convenience. One of the most outstanding changes with Vietnam visa policies is the visa waiver policies for some foreign nationals, according to which those visa-waived nationals will no longer be subject to a 30-day cooling-off period upon their latest exit, so they can enter and exit Vietnam freely. With changes to the new immigration law, taking effect in July 2020, foreign nationals will be allowed to change the visa purpose “entry purpose” in-country without leaving the country under some specific circumstances, and visa-waived nationals will no longer be subject to a 30-day cooling-off period. One of the big changes impact on the temporary residence card Vietnam for foreign investors is that, in the new law, they will be granted temporary residence cards “TRCs” with a duration up to 10 years (current law is maximum duration of 5 years) depending on the investment amount (the value of their contributed investment) on the investment and business registration certificate, dependents of foreign investors will be granted a visa or temporary residence card with a maximum of 3 years duration, renewable.

The New Immigration Law No. 51/2019/QH14 (“New Visa Policies 2020”) has been passed by the National Assembly of Vietnam on 25 November 2019 and will take effect on 1 July 2020. In this article, key changes and updates on visa policies of Vietnam for foreigners include: Allowing the change of entry purpose (change visa purpose) without leaving and re-entering Vietnam; Implementing new visa types and longer visa validity for foreign investors based on the value of their contributed investment; Foreign nationals who enter Vietnam under unilateral visa waiver status will no longer be subjected to the 30-day cooling-off period between the last exit date and the next entry date as before; Additional changes to the types Vietnam visa as ĐT1, ĐT2, ĐT3, ĐT4, LĐ1, LĐ2, EV and LS Visa, etc.

Since the Labor Code No. 45/2019/QH14 ("New Labor Code") have been passed by the National Assembly of Vietnam on 20 November 2019 and will take effect on 1 January 2021, some main changes are expected to have significant impacts on enterprises and organizations that recruit foreign labors in Vietnam. The New Labor Code changes the term of work permits, work permits extensions and work permit exemption for foreign labors in Vietnam. In particular, the term of a work permit in Vietnam is limited to a maximum of two years and the work permits can now only be extended once for a further two-year term. Foreign labors who want to continue working in Vietnam after the expiry of the extended work permit will have to apply for a new work permit.

Each country has a different name for criminal record certificate such as Police Check Clearance, Police Background Check, or Judicial Record Card. Criminal record certificate in Vietnam also known as Vietnam Police Check Clearance or Vietnam Police Background Check, Judicial Record Card is a required document for a number of purposes, including for most Work Permit applications, marriage certificate abroad, residence abroad, etc. Foreigners who had resided in Vietnam, held Vietnamese visa or temporary resident card (regardless of it has expired or not) but are living in their home country or a third country can now apply for a Vietnam Criminal Record Certificate without returning to Vietnam. All the required documents shall be provided via emails and the result will be issued within 10 days.
