STEP-BY-STEPS GUIDANCE

WHAT FOREIGNERS NEED TO DO FOR EACH STEP OF THE VIETNAM CRIMINAL RECORD PROCEDURE

Step 1:

Collecting documents for Vietnam Criminal Record

1. Passport
2. Vietnam Visa or Temporary Residence Card
3. Vietnam Temporary Residential certificate
   Obviously, passport and Vietnam visa or Vietnam temporary residence card (TRC) are always by your side. The other important document which may takes you a lot of time is the Temporary residence registration. This certificate must be confirmed by a local police where they are living. Sometimes the landlord support you the get it, but sometimes you have to do by yourself.

Step 2:

Filling out the Vietnam Criminal Record Application Form

If you already have passport, Vietnam visa/ TRC, Temporary residence registration with you, the next step is to fill the form. The form must be filled correctly and consistent with the documents you will submit to the Department of Justice. The required information in the form are:

• Your personal information
• Residential address in your home country
• Temporary address in Vietnam
• Phone number and email
• Full name – Date of birth of your father
• Full name – Date of birth of your mother
• Full name – Date of birth of your spouse (if any)
• History of your residence from the age of 14 (including period of time, address, job and workplace)
• Which type of Vietnam criminal record you wish to apply? – Number 1 or Number 2
• Purpose of doing Vietnam criminal record

Step 3:

Submitting the documents of Vietnam Criminal Record to the Department of Justice of the province or city where the applicant is residing or via postal service

Required documents if submitted Vietnam Criminal record directly by presenting at the Department of Justice

1. A Criminal Record Application Form with your signature
2. An original valid passport & latest Vietnam entry stamp and a copy of it
3. An original valid Vietnam visa or TRC and a copy of it
4. An original Vietnam Temporary Residential certificate and a copy of it

Required documents if submitted Vietnam Criminal record directly via postal service:

1. A Criminal Record Application Form with your signature
2. A notarized true copy of your valid passport & latest Vietnam entry stamp
3. A notarized true copy of valid Vietnam visa or TRC
4. A notarized true copy of  Vietnam Temporary Residential certificate

Step 4:

Receiving a result of Vietnam Criminal Record Card by coming to pick up at the Justice of Department or via postal service

The normal processing time for issuance of a Vietnam Criminal Record card is from 15 to 20 days from the date of submission. There are 02 options of taking result at this stage:

• Coming directly to the Justice department to take result due to the return date on the receipt.
• Using postal service for to take the result. With this method, you will have the result after 1-2 days comparing to return date on the receipt.

You need to fill in all the required information in the form:

Step 3:

Submitting the documents of Vietnam Criminal Record to the National Center for Criminal record via postal service

1. A Criminal Record Application Form with your signature
2. Certified copy/authentication of your valid passport
3. Power of attorney authorizing another person to carry out procedures to request the issuance of a Criminal Record (Authorization document must be notarized and authenticated according to the provisions of Vietnamese law or the law of the country where the person resides).
   In case of authorization according to the laws of the country where the person requesting the Voucher is residing, the authorization document must be consular legalized following the provisions of Vietnamese law. Nam at the Vietnamese Embassy/Vietnamese Consulate and translated into Vietnamese)
4. A copy of a valid Passport authenticated at the Vietnamese Embassy/Consulate in the country where you are living. (Note: Passport with the latest stamp of entry and exit into Vietnam)
5. A copy of ID card of the person who is authorized to submit the document on behalf of the foreigner
6. Registration form to receive results by post so that when your application is processed, it will be sent to you by post at the address you registered.

Step 4:

Receiving a result of Vietnam Criminal Record by through the postal service

After 15-20 days (normal processing time for a Vietnam Criminal Record application) & 01-02 days for delivery, you can have in hand the result of Criminal Record certificate.
