REQUIREMENTS AND PROCESSING TIME FOR VIETNAM WORK PERMIT EXTENSION 2023

Currently, many businesses are hiring foreign employees and also sponsor for their work permit. But when his/her work permit is going to be expired, instead of applying for a new Work Permit, the company can choose to extend the work permit which saves not only time but also costs. Especially when there are many changes in regulations on extension of Vietnamese work permits according to Decree 152/2020/ND-CP of the Government effective from 15/02/2021. Therefore, the business need to update and apply it based on the current regulation at that situation. I CONDITIONS FOR APPLYING VIETNAM WORK PERMIT EXTENSION 2023

  1. The issued work permit is still valid for at least 05 days but not more than 45 days.
  2. Get approval from the competent authority for the need to employ foreign workers specified in Article 4 or Article 5 of this Decree.
  3. Documents proving that the foreign worker continues to work for the employer according to the contents of the issued work permit.

 

II REQUIRED DOCUMENTS FOR VIETNAM WORK PERMIT EXTENSION ACCORDING TO THE DECREE 152/2020/ND-CP

  1. The employer's written request for extension of the work permit, made according to Form No. 11/PLI of Decree 152/2020/ND-CP.
  2. 02 color photos (size 4 cm x 6 cm, white background, straight face, bare head, not wearing colored glasses), photos taken within 06 months from the date of application.
  3. The valid work permit has been granted.
  4. Job position approval letter granted.
  5. Certified copy of valid passport as prescribed by law.
  6. Health certificate or medical examination certificate as prescribed.
  7. One of the documents specified in Clause 8, Article 9 of Decree 152/2020/ND-CP proving that the foreign worker continues to work for the employer according to the content of the issued work permit:
    ♦ For foreign workers moving within the enterprise: must have a document of the foreign enterprise sending to work at the commercial presence of that foreign enterprise in the territory of Vietnam and a document proving that foreign workers who have been recruited by that foreign enterprise before working in Vietnam for at least 12 consecutive months
    ♦ For foreign workers performing various types of contracts or agreements on economics, commerce, finance, banking, insurance, science and technology, culture, sports, education and vocational education Industry and healthcare: there must be a contract or agreement signed between the Vietnamese side and the foreign side, in which there must be an agreement on the foreign workers working in Vietnam.
    ♦ For foreign workers who are service providers under contract: there must be a service provision contract signed between the Vietnamese side and the foreign side and a document proving that the foreign worker has done the service. working for a foreign enterprise that has not had a commercial presence in Vietnam for at least 2 years.
    ♦ For foreign workers entering Vietnam to offer services: there must be a document from the service provider sending foreign workers into Vietnam to negotiate service provision;
    ♦ For foreign employees working for foreign non-governmental organizations or international organizations in Vietnam that are permitted to operate in accordance with Vietnamese law: there must be a document from the agency or organization that appoints such person. foreign workers coming to work for foreign non-governmental organizations and international organizations in Vietnam, except for cases where foreigners perform labor contracts in Vietnam and operate permits of foreign non-governmental organizations. foreign organizations and international organizations in Vietnam as prescribed by law.
    ♦ For foreign workers who are managers, executives, experts or technical workers: there must be a document from the foreign enterprise, agency or organization sending the foreign worker to work in Vietnam and suitable for the intended position.

Note: All documents issued by foreign authorities (degrees, certificates, confirmation of experience, appointment letter, medical certificate, criminal record, etc.) must be completed and consularly legalized and legal translation into Vietnamese, except for cases where consular legalization is exempted.

 

III STEPS TO APPLY WORK PERMIT EXTENSION 2023

► Handling authority: The Ministry of Labor - Invalids and Social Affairs or the Department of Labor - Invalids and Social Affairs

► Number of extension allowed: ONLY one time

 

IV VALIDITY OF WORK PERMIT AFTER EXTENSION

According to Article 19 of Decree 152/2020/ND-CP, the term of a work permit may be extended according to the term of one of the cases specified in Article 10 of Decree 152/2020/ND-CP but only be extended once with a maximum term of 2 years.
