[1] - BRIEF INFORMATION OF VIETNAM WORK PERMIT FOR FOREIGN TECHNICAL WORKER

<> WHAT IS IT?

Vietnam Work Permit is required for foreign technical worker would like to work in Vietnam more than 3 months. It is also possible to apply for the work permit in advance of arrival in the country, the employer usually helps organise the application on the employee’s behalf. Of course, you do not need to issue it if you work under 3 months, so let’s make sure that do not overstay and is expelled by Vietnam police.

For companies seeking to employ foreign workers, a recruitment plan by the company must be submitted at least thirty days in advance of the workers arrival to the provincial Department of Labor, Invalids and Social Affairs (DoLISA). Authorities are becoming stricter regarding work permits.

<> REQUIREMENTS?

Foreign workers have to have a sponsored company in Vietnam and be employed by it.

<> WHERE IS VIETNAM WORK PERMIT ISSUED?

Vietnam Work Permit is granted by:

- Department of Labor, Invalids and Social Affairs (DoLISA)

- Management of Industrial zones or Export processing zones

This is one of the priority that Vietnam Government carried out with the aim at facilitating more favorable conditions for foreign enterprises or workers to obtain Vietnam Work Permit.

[2] - WHO CAN APPLY VIETNAM WORK PERMIT?

There is capacity for civil acts fully in accordance with the law;
There is health fit with the job requirements;
Being a manager, executive director, expert or technician;
Not offenders or being prosecuted for criminal liability in accordance with the law of Viet Nam and foreign law;
Being approved in writing by the competent State agencies on the use of foreign workers.

[3] - REQUIRED DOCUMENTS FOREIGNER MUST OBTAIN WHEN WORKING IN VIETNAM
Foreign technical worker has to hold three following documents to be permitted to work in Vietnam legally during a given period of time. Of course, you will be expelled and penalized by Vietnam Police if you violate the labor law.

[4] - HOW FOREIGN TECHINICAL WORKER CAN GET VIETNAM WORK PERMIT

A foreign technical worker has to go through two steps:

Step 1: Submit Form No 1 - explanation of foreign labor usage plan to Department of Labour, Invalids and Social Welfares

Before at least 30 days since the day foreign labors anticipated to work for employer units (companies, contractors, representative office,…) these units shall submit documents as requested to grant work permit to Department of Labour, Invalids and Social Welfares at where foreign labor expected to work.

Step 2: Prepare and Submit required documents for Work Permit Issuance

<> Required documents for foreign labour

You should contact a trusted work permit service provider to get the furthest information. Basically, following are documents you must prepare and submit to your provider:

Education background i.e bachelor, master, doctorate or appropriate qualifications;
Required documents for technical worker position who had received technical or other specialized training for least 01 year and worked at least 03 years in the sector of specialized training.
Foreign Police Clearance Certificate
Health certificate or medical certificate issued by a competent foreign or Vietnamese health care agency or organization valid for 12 months from the date of signing to the application date;
2 recent color photos with size 4x6cm (white background, front, bareheaded, without sunglasses), taken within 06 months prior to the application date.
2 notarized copies with full pages (the notarization procedure can be made in Vietnam by public notary office within 3 months before the submission date)

<> Required documents for Company

Request for issuance of a work permit from the employer in accordance with regulations of the Ministry of Labor - Invalids and Social Affairs;
The written position approval of Department of Labor, War Invalids and Social Welfare.
Notarized true copy of business registration certificate; or investment registration certificate; or representative office license; or contractor permit license;
Notarized true copy of power of attorney if the signer is not a legal representative of the company.
