VIETNAM WORK PERMIT EXEMPTION CONDITIONS

Work Permit is a legal paper granted by Department of Labor, Invalids and Social Affairs (DoLISA). However, some cases are included in Work Permit Exemption, which means that foreign workers do not need to issue Work Permit for working in Vietnam. You might wonder whether you are forced to issue Work Permit or not since you do not know which specific cases and conditions will be met Vietnam Work Permit Exemption. VIETNAM WORK PERMIT EXEMPTION CONDITIONS
To be able to work in Vietnam longer than 3 months, foreigners are required to possess a Vietnam work permit. However, there are certain conditions for foreign workers to exempt from Vietnam work permit. You are legally exempted from Vietnam work permit if you are one of those mentioned in the list below:

 

  1. Owners or capital contributors of limited liability companies;
  2. Members of the Board of Directors of joint-stock companies;
  3. Chiefs of representative offices and directors of projects of international organizations or NGOs in Vietnam;
  4. Foreigners staying in Vietnam with business purposes for lessthan 90 cumulative days in 1 year;
  5. Foreign workers who are transferred to Vietnam by their company operating in one of these 11 service sectors: business, communication, construction, distribution, education, environment, finance, healthcare, tourism, cultural entertainment and transport;
  6. Foreign employees enter Vietnam to provide advisory services and technical expertise or perform other tasks serving research, construction, appraisal, monitoring and evaluation, management and implementation of programs/projects funded with Official Development Assistance (ODA) as specified and agreed in international agreements on ODA between competent authorities of Viet Nam and other countries;
  7. Foreign workers who are issued with a license for the practice of journalism in Vietnam by the Ministry of Foreign Affairs in accordance with the law;
  8. Foreign teachers of teachers working for international schools under the control of foreign embassies or international organizations, or got permission from the Ministry of Education and Training to teach and research in Vietnam’s education and training institutions;
  9. Authorized volunteers from international organizations in Vietnam, students working as an intern for Vietnamese enterprises;
  10. Foreign workers entering Vietnam to implement international agreements to which central and local state agencies are signatories as prescribed by the law;
  11. Family members of diplomatic agents of foreign diplomatic missions in Vietnam permitted for working by the Ministry of Foreign Affairs, except where international treaties to which the Socialist Republic of Vietnam is a signatory that contains provisions different from this;
  12. Foreign workers who have official passports to work for state agencies, social organizations and socio-political organizations;
  13. Other cases decided by the Prime Minister at the proposal of the Ministry of Labor - Invalids and Social Affairs.



IMPORTANT DOCUMENTS FOR VIETNAM WORK PERMIT EXEMPTION
Foreign employees in the above cases are required to provide papers proving that they are exempted from Vietnam work permit to the Department of Labor, Invalid and Social Affairs where their company located. The processing duration is about7-10 working days. The application dossier of Vietnam work permit exemption should include:

 

  1. Request for Vietnam work permit exemption;
  2. Profile of the foreign laborconsisting of full name, age, gender, nationality, passport number, start date and end date of employment, job placement of the foreign labor;
  3. Proof of eligibility for Vietnam work permit exemption comprises 01 photocopy to be collated with the original or 01 certified copy. Foreign documents are exempt from consularization, but must be translated into Vietnamese and certified in accordance with Vietnam laws.
  4. Documents relating to the foreign enterprises: Investment license, business registration certificate, establishment licenses (for headquarters or branches);
  5. Notarized true copy of the passport.
