LOSING WORK PERMIT VIETNAM – DETAILED STEPS AND CHECKLIST

If you are a foreign worker in Vietnam and want to stay long terms in Vietnam, you will know how important it is to have a valid work permit. A work permit is a legal document that allows you to work legally in the country, and it also affects your visa status and other documents in Vietnam. But what if you lose your work permit? How can you get a replacement for your work permit? And what are the consequences of not having it?

Losing your work permit can be a nightmare, especially if you don’t know what to do next. That’s why we have this article to guide you through the process of re-issuing your work permit in Vietnam. When you lose your Vietnam Work Permit, you will do a process called Work Permit Replacement, Work Permit Renewal, or Work Permit Re-issuance (Under Clause 1, Article 12 of Decree 152/2020/ND-CP and Decree 70/2023/ND-CP). We will explain the documents and procedures that you need to prepare, the steps that you need to follow, and the duration of the re-issued work permit in this article.

I. DURATION OF A WORK PERMIT REPLACEMENT

According to Article 15 of Decree No.152/2020/ND-CP (and this does not change according to Newest Decree No. 70/2023/ND-CP), work permit replacement is equal to the term of the lost work permit minus the time the foreign worker has worked up to the time of the request for reissue of the work permit.

For example:

The original work permit was issued with a working period from October 20, 2022, to October 19, 2024.

Unfortunately, you lost your license on April 9, 2023, and then you applied for a loss report with the Labor Department and required for re-issuance on April 11, 2023.

Your new license will be reissued with the remaining validity of the working period from April 14, 2023, to October 19, 2024.

II. DETAILED STEPS AND CHECKLIST TO GET A REPLACEMENT OF LOST WORK PERMIT

The documents to apply for a work permit re-issuance are quite simple but you need proof that you truly lost your current work permit and desire to get a new work permit for working, you will need to prepare the following documents:

Step 1: Prepare the documents according to the above-mentioned checklist.

The report of losing the work permit must be certified by the ward police station where the foreign expatriate is residing. (Explanation form for losing the work permit) – THE MOST IMPORTANT DOCUMENT;
Application forms to request for Work Permit REPLACEMENT;
02 color photos (size 4 cm x 6 cm, white background, straight face, bare head, no colored glasses), taken no more than 6 months before the date of application;
A NOTARIZED TRUE COPY OF Job position approval letter;
A notarized true copy of the passport;
A PHOTOcopy of the lost work permit;

Step 2: Submission.

The Company needs to submit the application requesting to reissue a work permit with the reason for losing it at the Department of Labor, Invalids, and Social Affairs (DOLISA).
Method of submitting is under 02 steps (both online and paper submission).

Step 3: Getting the result.
