PROCEDURE TO GET WORK PERMIT AT BINH DUONG INDUSTRIAL ZONES AUTHORITY

In genreal, there are 02 steps to apply for a Vietnam work permit for foreign workers in Binh Duong:

Step 1: Registration of the need of using foreign labors

A legal entity in Binh Buong Industrial Zone must submit Form No 1 - Explanation of foreign labor usage plan to the People's Committee of Binh Duong Province and wait for their response whether to approve the use of foreign labors.

What should be necessary information in the registration application of the foreign labor usage?

Enterprise/organization information;
Fields of business;
Total number of employees working at the enterprise, organization and of which, the number of foreign workers
Job position;
Job title;
Quantity;
Expected working time in Vietnam;
The reason for recruiting foreign worker.

Step 2: Work Permit Application Vietnam and Issuance

Depending on the working form as labour contract or internal transfer, the position, job title being approved by the People's Committee of Binh Duong Province, the company and the foreign workers will prepare necessary documents for the application.

CONDITIONS FOR FOREIGNERS TO GET VIETNAM WORK PERMIT IN BINH DUONG

To get a work permit in Vietnam, applicants must meet the following conditions:

Over 18 years old;
Have a good health condition that satisfies the job’s specific demands and requirements;
Free of any criminal record in their country or a national security offense, not currently facing criminal prosecution, or not serving a criminal sentence by the Vietnamese and foreign policemen during the assignment;
Have a high degree of specialized knowledge, technology, and qualification; experienced in business, management and other professions that Vietnamese labors are currently unable to conduct efficiently.

REQUIRED DOCUMENTS FOR NEW ISSUANCE VIETNAM WORK PERMIT IN BINH DUONG FOR FOREIGN WORKERS

Request form for Vietnam work permit (Form No. 06 issued together with the Circular No. 03/2014/TT-BLDTBXH)
The approval letter of the Chairman of the People's Committee in Binh Duong on foreign labourer usage.
Health check Certificate granted abroad or in Vietnam (referred to regulation of Ministry of Health of Vietnam)
Criminal records (issued within 180 days) issuing by Vietnam National Centre for Criminal Record / Department of Justice of Binh Duong province / foreign authorities
Letter of work experience or expertise certificate confirmed by former employers (foreign company outside of Vietnam) with at least 3-year experience in the relevant position that foreign labors are targeting.
Two (02) coloured photos (size 4cmx 6cm; bared head, frontal view; showing face and ear clearly; non-glasses; white background), taken within 06 months.
Photocopy of the whole passport

Document #3,4,5 must be consularized before being used in Vietnam

Depending on the working form, the foreign labors must submit some additional documents:

► For Labor contract: The document proving that the foreign worker is engaged in the operation of that foreign enterprise includes one of the following documents:

Labor contract;
The written certification of the employer;
Decision to recruit foreign workers;
Tax or insurance certificate of the foreign worker.

► For Internal transfer:

Letter of appointment;
Documents proving that the foreign worker has been recruited by the foreign enterprise before working in Vietnam for at least 12 months, including one of the following documents:
- Labor contract;
- The written certification of the employer;
- Decision to recruit foreign workers;
- Tax or insurance certificate of the foreign worker.
